Grievance of the petitioner is that the petitioner has not received the pensionary benefits on the death of her husband.

According to the petitioner, her husband was working as contingency paid employee under the respondents since 1969 and was regularized in service on 24.8.2007 and he died in harness on 16.5.2017, however, the respondents have till date not considered the case of the petitioner for grant of pension and pensionary benefits. 3.

Given the fact that the petitioner's husband has put in more than 10 years of regular service and before being regularized he had put in about 30 years of service as contingency paid employee, the case of the petitioner does require consideration by the authorities for grant of pension and pensionary benefits in the light of the judgment delivered by a Division Bench of this High Court in the case of Lakhan Ram Sahu & Others v. State of Chhattisgarh & Others decided on 26.2.2015 in Writ Appeal No. 281 of 2013.

Let this exercise be completed by the respondents no. 2 to 4 at the earliest, preferably within a period of four months from the date of receipt of copy of this order. 5.
