Agrawal Order on Board 19/12/2019 1.Petitioner herein filed MCRC(a) No. 173/2017 before this Court for grant of anticipatory bail in connection with Crime No. 117 of 2017. It is the case of the petitioner that he also submitted his mobile phone in a sealed envelope in that application filed before this Court. Now, the said mobile phone is required for trial so, he moved an application before the Additional Registrar for the same, but the mobile phone has not been returned to him therefore, appropriate

writ be issued for directing the respondent Authority to return the said mobile phone.

2.I have heard learned counsel for the parties at length.

3.If the petitioner has submitted his mobile phone along with the application filed by him before this Court i.e. MCRC(a) No. 173/2017, no writ can be issued to the respondent - High Court for the return of the said mobile phone to the petitioner. However, the petitioner is at liberty to proceed in accordance with law.

4.With the aforesaid liberty reserved in favour of the petitioner, this writ petition stands disposed of. No cost(s).
