1. The applicant has preferred this application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No. 09/2020 registered at Police Station Siksod, District Kanker, C.G. for the offence punishable under Sections 10, 13, 17, 38(1)(2), 40, 22(x) & 22(2) of the Unlawful Activities Prevention Act, 1967, under Section 8(2)(3)(5) of Chhattisgarh Vishesh Jan Surakasha Adhiniyam and under Section 120B, 201, 149, 34 of Indian Penal Code.

2. Learned counsel for the applicant submits that he does not want to prosecute this application and seeks to withdraw the same with liberty to approach appropriate forum. However, he prays for return of certified copy of the impugned order.

3. Permission granted.

4. Accordingly, the application MCRC No.8997 of 2020 is dismissed as withdrawn with the aforesaid liberty.

5. Registry is directed to return the certified copy of the impugned order to the counsel for the applicant on his furnishing true authenticated Xerox of the same.
