Shri S. R. J. Jaiswal, Panel Lawyer Hon'ble Shri Justice P. Sam Koshy Order On Board /11/2016 The present petition under Section 482 CrPC has been filed assailing the filing of charge sheet by the respondents before the Court of JMFC, Durg in Criminal Case No. 149 of 2016.

The allegation that is leveled against the petitioner is of very serious nature and the offence which has been registered is under Sections 354, 376 & 506 of IPC. The charge sheet has been filed on the basis of the materials which have been collected during the course of investigation and on the basis of which this Court does not find any strong material for interfering with the same. 3.

However, the contentions and the submissions put forth by the counsel for the petitioner can still be looked into by the Court below at the time of framing of charge as he would get an opportunity of making his argument before framing of charge.

Reserving the right of the petitioner for raising all his arguments that have been raised in this petition at the time of framing of charge, the present

petition is dismissed being devoid of merit.
