1. The applicants have preferred the bail application under Section 438 of the Cr. P.C. for grant of anticipatory bail as they apprehend their arrest in connection with Crime No. 06/2010, registered in Police Station AJAK, District Bilaspur (CG), for offence punishable under Sections 147,148.452, 323, 427 of IPC and Sectioln 3 (1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Learned counsel appearing for the applicants seeks permission of this court to withdraw the instant bail application with liberty to move an application under Section 439 of Cr.P.C., before the trial Court.

Prayer is just and reasonable, therefore, permission is granted. 4.

Accordingly, the instant bail application is dismissed as withdrawn with the aforesaid liberty. If the applicants move an application under Section 439 of Cr.P.C., before the competent criminal Court, the same shall be decided in accordance with law expeditiously, without any delay. Sd/- (I.S.
