Heard on Cr.M.P. followed by acquittal appeal preferred against the judgment dated 9-7-2014 passed by the Judicial Magistrate First Class, Raipur in Criminal complaint Case No. 909/2013 whereby and whereunder learned trial Court acquitted the accused for charges framed under Section 138 of the Negotiable Instrument Act. The Cr.M.P. is within limitation.

On due consideration, this Court is of the view that special leave to appeal may be granted. Consequently, the present Cr.M.P. is allowed. Registry is directed to list the matter under the head of acquittal appeal.

Record of the Court below be called for through usual and fax mode.

On appellant's paying process fee within 7 days, notice along with a copy of acquittal appeal be issued to the respondent through registered and usual mode, returnable within 4 weeks.
