1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.806 of 2016 registered at Police Station Kotwali, Rajnandgaon (CG) for the offence punishable under Sections 420, 467, 468, 471, 34 of IPC.

3. The applicant is working as Teacher at Utkarmi Madhya Vidyalaya, Kushwar, Ramkanda, District Gadwa, Jharkhand. One Saddam Mansuri applied for the post of Peon in the recruitment process initiated by the Collector, Rajnandgaon. In the course of scrutiny of the papers, the Recruiting Agency raised doubt over the genuineness or authenticity of the Class

VIII marksheet submitted by Saddam Mansuri, therefore, the same was sent for verification to the School from where it was purportedly issued. During verification, the mark-sheet was found to be forged. Saddam Mansuri made statement to the Police that it was the applicant, who has supplied the mark sheet to him upon receipt of payment of Rs.5000/-. On the applicant's memorandum, zerox copy of the mark sheet of Saddam Mansuri has also been recovered from him.

4. Learned counsel for the State would oppose the bail application. However, he would submit that the concerned Police has not reported any previous antecedents of the applicant.

5. Considering the fact that the applicant is in jail since 19.01.2017; the offences are triable by the Judicial Magistrate First Class and; the charge sheet has already been filed, this Court is inclined to release the applicant on regular bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
