Heard the matter finally.

Learned counsel for the applicant would submit that the applicant held arrested in connection with Crime No.330/16 on 21-12-2016 by P.S. Bodhghat, District Bastar, C.G. for the offence under Section 370 read with Section 34 of the IPC. After investigation police had filed the charge sheet which is registered before the JMFC Jagdalpur, C.G. as Criminal Case No.248/17. The matter is probably committed to the Court of Sessions, but learned counsel for the applicant is not aware of the sessions trial number. Learned counsel for the applicant would further submit that police had filed the charge sheet against total 5 accused persons Tillu Randhari, Sukhram Sori, Sattu Nag, Betu Bhatra and the present applicant. Sukhram Sori is the main accused. The applicant is in custody since 21-12-2016. He is first offender. He may be granted bail. 3.
Per contra, learned counsel for the non-applicant/State opposed the argument advanced on behalf of the applicant and would submit that in the statement recorded under Section 161 of the Cr.P.C. it appears that the applicant is also involved actively in human trafficking of many persons including 11 minor girls, 18 minor boys.

On consideration of the fact that the matter comes under the ambit of Section 370 sub-section 5 of the IPC. Looking to the evidence collected, I am not inclined to grant bail to the applicant. Consequently, the instant MCRC is hereby dismissed.
