Heard on application for grant of leave to appeal. Perused the statement of PW-3 victim and doctor PW-1. Considering the same, in the opinion of this court prima facie the issue needs to be gone into for adjudication.

Considering the same, leave to appeal is allowed. Registry is directed to register the case as acquittal appeal. Let bailable warrant for a sum of Rs.5000/- be issued against the respondent for his appearance before this court on 28th November, 2017. List the case case on 28th November, 2017.
