The complaint filed by the petitioner before the Court of CJM, Baloda Bazar was dismissed in default for the reason of non appearance of his counsel, who was indisposed on the date fixed for hearing.

Considering the grounds mentioned in the application, the application is allowed and leave to appeal is granted. The Registry is directed to list this case as regular acquittal appeal and proceed further.
