This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants, who have been arrested in connection with Crime No. 12/2015, registered at Police Station Dongaripali, District Raigarh, C.G., for the offence punishable under Section 20(B) of the N.D.P.S. Act.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence; quantity of Ganja i.e. 40 Kg. seized from the vehicle in question, in which, applicants were present, which is said to be commercial quantity and taking into account the provisions contained in Section 37(1)(b) of the N.D.P.S. Act, this Court is not inclined to release the applicants on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is

rejected.
