The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.256/2016 registered in Police Station Tamnar, District Raigarh (C.G.) for offence punishable under sections 394, 34, 120(B) of IPC.

As per the prosecution case, on 3/11/2016 a complaint was made by Rakesh Kumar Agnihotri that the present applicant alongwith the other co-accused has dashed him by kick, when he fell down looted amount of Rs.2,46,000/-.

Learned counsel for the applicant submits that the applicant is in jail since 3/11/2016, no considerable progress has taken place and the complainant has already been examined, therefore chance of tampering of evidence is also over and there are contradiction in the statement and also identification at the presence of the police, therefore the applicant may be released on bail.

On the last date of hearing learned State counsel was directed to apprise the status of the case. Learned State counsel submits that status
has not been informed by the concerned authority. 5.
Under the circumstances, taking into fact that the applicant is in jail since 3/11//2016 and the complainant has been examined, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
