(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No.

170/2015 registered at Police Station Basantpur, Rajnandgaon for the offence punishable under Section 326-A of the Indian Penal Code.

(2) Case of the prosecution, in brief, is that applicant caused grievous hurt to Mangilal and five other persons by throwing acid to them and thereby committed the aforesaid offences.

(3) Counsel for the applicant submits that applicant has been falsely implicated in the offence in question as he has not committed any offence. He further submits that the applicant is in jail for fairly long time and no useful purpose would be served in detaining him in jail and, therefore, the applicant may be released on bail.

(4) On the other hand, counsel for the State opposes the bail application.

(5) Considering the totality of the facts and circumstances of the case, looking to the seriousness of the offence and the manner in which acid was thrown upon the victim - Mangilal, by which, he sufferred 40% burn injuries & taking note of the injuries suffered by other victims, I am not inclined to release the applicant on bail. Thus, the bail application is rejected. However, the trial Court is directed to expedite the trial. Certified copy, as per rules.
