Learned counsel for the applicant seeks permission of this Court to withdraw the instant criminal revision filed under Section 397 read with 401 of Cr.P.C. with liberty to file suitable application under Section 439 of Cr.P.C., before the trial Court. It is ordered as prayed for.

Accordingly, the criminal revision filed under Section 397 read with Section 401 of Cr.P.C. is dismissed as withdrawn with aforesaid liberty.
