1. First bail application preferred by the applicant was dismissed on merits by this Court vide order dated 10.08.2021 in MCRC No.4858 of 2021.

2. The applicant has preferred this second bail application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No.85/2021 registered at Police Station- Azad Chowk, District Raipur, C.G. for the offence punishable under Section 376(2)(n) of IPC.

3. Learned Counsel for the applicant submits that he does not want to press this bail application and seeks to withdraw the same with liberty to repeat his prayer for bail, if the trial is not concluded

within a period of eight eights from today.

4. Accordingly, the bail application is dismissed as withdrawn with the aforesaid liberty. Considering the contention of the counsel for the accused as is reflected from the order dated 01.12.2021 of the trial Court that one of the relatives of the prosecutrix is in police who is PW-4 in the case, deliberately summons are not being served upon the prosecutrix and other witnesses by the police, though as per the summons report of the prosecutrix she is said to be ill which is totally false, the trial Court is directed to expedite the trial and conclude the same preferably within a period of eight months from today.
