(2) This is the first bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.494/2014 registered at Police Station Bhilai Nagar, District Durg, for the offence punishable under Sections 302, 201, 120-B, 34 of the Indian Penal Code. (3) Learned counsel appearing for the State would submit that out of twelve material prosecution witnesses, only nine material

prosecution witnesses have been examined before the trial Court and, therefore, the applicant is not entitled for grant of bail. (4) Taking into consideration the facts and circumstances of the case, nature and gravity of the offence and the fact that trial is on advance stage, the application is disposed off with a direction to trial Court to expedite the trial and conclude the same expeditiously.
