Sam Koshy Order On Board 13.09.2018 The present writ petition has been filed seeking for a direction to the respondents to consider the claim of the petitioner for the post of Lecturer (Panchayat) against the recruitment process which was initiated in the year 2017.

The advertisement was published on July, 2017. The petitioner had applied for Lecturer Panchayat Physics. The number of vacancy for the
said post was only one which too was reserved for ST category. The petitioner belongs to unreserved category (general). The petitioner knowing fully well that there was no post available for an unreserved category applied for the same which was scrutinized and entertained by the respondents inadvertently but for the reason that the petitioner was not belonging to ST category, his candidature was not considered which led to the filing of the present writ petition.

This Court is not inclined to accept the contention of the petitioner for the simple reason that the petitioner at the outset was not eligible for applying for the said post which was reserved for ST category as the petitioner belonged to unserved (general) category, therefore, he does not have any legally enforceable right whatsoever in his favour. 4.
The writ petition thus being devoid of merits deserves to be and is accordingly dismissed.
