On due consideration, for the reasons stated in the application, delay in filing the appeal of 43 days is condoned.

Also heard on application for grant of leave to appeal. Perused the statement of PW-1 and PW-2.

Considering the statement, application for grant of leave to appeal is allowed.

Registry is directed to register the case as acquittal appeal. Since respondent is already represented no further notice is required. Respondent is directed to furnish bail bond of Rs.25,000/- and surety in

the like sum before the learned court below within a period of one month so that presence of respondent can be procured before this court as and when required.
