Hon'ble Shri Justice Gautam Chourdiya Order on Board 14/12/2020

1. The applicant has preferred this application under Section 439 of Cr.P.C. as he is in jail since 19.08.2020 in connection with Crime No.85/2020 registered at Police Station- A.J.K. Korba, District Korba, C.G. for the offence punishable under Sections 363, 376, 120-B, 34 of Indian Penal Code, under Sections 4, 6 of the Protection of Children from Sexual Offences Act, 2012 and under Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), Act, 1989.

2. Learned counsel for the applicant seeks to withdraw this bail application with liberty to file a duly constituted appeal {under Section 14-A of the Scheduled Castes and Scheduled Tribes

(Prevention of Atrocities), Act, 1989} afresh. However, he prays for return of certified copy of the impugned order.

3. Accordingly, the application stands dismissed as withdrawn with the aforesaid liberty.

4. Registry is directed to return the certified copy of the impugned order to the counsel for the applicant on his furnishing true authenticated Xerox of the same.
