Grievance of the Petitioner is to the inaction on the part of the Respondent authorities in not taking a decision on his representation made on 17.03.2021 (Annexure P/6).

Learned counsel for the Petitioner submits that the petitioner was performing his duties as a Constable and owing to the complaint lodged by one Dashrath Lal Sahu, an offence punishable under Section 420/34 IPC has been registered against him and his wife and during the course of trial, a compromise was arrived at between the parties and the Petitioner was accordingly acquitted of the charges as levelled against him under Section 420/34 IPC. It is contended further that in the meantime, the Petitioner had

completed the course of Head Constable and his name was found place in the fit list candidates at Sl.No. 93, for which, the Petitioner has submitted a representation on 17.03.2021 before the Commandant, 1st Battalion, Chhattisgarh Armed Force, which was forwarded to Respondent No.2., however, the same has not been decided. It is, therefore, submitted by the learned counsel appearing for the Petitioner that the Respondent authorities be directed to consider and decide the said representation as made by the Petitioner on 17.03.2021 (Annexure P/6) at the earliest, to which learned counsel appearing for the State has raised no objection. 3.

In view of above, the Court feels that no fruitful purpose would be served in keeping the writ petition pending as it can be disposed of at this stage itself. Accordingly, this petition is disposed of by directing Respondent No.2 - Director General of Police to take appropriate decision on the said representation made on 17.03.2021 (Annexure P/6) as expeditiously as possible, preferably within a period of 2 months from the date of communication of the order of this Court.

It is made clear that while disposing of the petition, I have not expressed any opinion on the merits of the case and the concerned authority shall decide the same in accordance with law. 5.
