This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 191/15, registered at Police Station Baradwar, Dist. Janjgir Champa (C.G.), for the offence punishable under Sections 451, 380, 328 of I.P.C.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence and the manner in which gold and silver articles held by complainant Anil Sahu was stolen by the present applicant which is said to have been recovered from the applicant, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
