1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.765/2016, registered at Police Station Bemetara, District Bemetara for the offence punishable under Sections 498-A, 307, 304 B read with 34 of IPC.

3. The applicant is the sister-in-law (Nanand) of deceased Poonam,

who was married with her brother Rajesh Kumar Verma in the year 2014. There are three dying declarations of the deceased. In each one of the said statements, the deceased had alleged that her mother-in-law Uma Verma set her on fire. As against the present applicant, the allegation is only to the effect that she was harassing and torturing the deceased by making taunts or comments that she has not prepared quality food or other allegation pertaining to normal wear and tear of daily life of a married woman.

4. Considering the nature of allegations against the applicant as also for the reason that she is in jail since 31.12.2016, this Court is inclined to release the applicant on regular bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on her executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. She is directed to appear before the trial Court on each and every date given by the said Court.
