This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.17/2017, registered at Police Station Kumhari District Durg (CG) for the offence punishable under Sections 302 of IPC and 4, 5 of the Tonhi Pratadna Adhiniyam. 3.

The applicant allegedly committed murder of deceased Punoutin Bai by setting her ablaze after pouring kerosene oil. The prosecution is based on circumstantial evidence in the form of extra judicial confession and dying declaration.

Having gone through the case diary and having considered the quality of evidence available against the applicant, this Court is not inclined to release the applicant on bail.
