In an application filed by the respondent/wife under Section 125 of the CrPC the Jude, Family Court, Ambikapur, in Misc. Criminal Case No.163/2014 on 12.8.2015 after full fledged inquiry finding that relationship between husband and wife has been duly established, the respondent is unable to maintain herself and she is having sufficient cause to live separately from her husband, granted maintenance of Rs.1000/- per month from the date of order, which is sought to be challenged by the petitioner in this revision on the ground that there is no sufficient reason to live separately by the respondent.

The Family Court has clearly recorded the finding that the respondent is residing separately on account of sufficient cause and she is legally wedded wife of the petitioner and having no source of income of her

livelihood and has granted Rs.1000/- per month as maintenance to the respondent.

After hearing learned counsel appearing for the petitioner and after gone through the finding recorded by the Family Court, I do not find any illegality in the order impugned.

Consequently, the revision is liable to and is hereby dismissed at the admission stage itself without notice to other side. 5.
