The applicant has preferred this bail application under Section 439 of Cr.P.C. in connection with Crime No.80/2017 registered at Police Station Kotwali, Dhamtari (C.G.) for the offence punishable under Sections 384, 385, 424 & 406 r/w 34 of IPC.

Present applicant is in jail since 09/03/2017. 3.
Present is a repeat bail application.

The earlier bail application stood rejected by this Court on 14/06/2017 on merits taking into consideration the gravity of offence and also the role played by the present applicant.

Present repeat bail application has been filed only on the ground of delay in between.

Considering the facts and circumstances of the case, particularly taking note of the order passed by this Court on the earlier occasion and the grounds alleged therein, this Court does not find any strong case made out by the counsel for the applicant for grant of bail to the present applicant. 7.
Accordingly, the instant MCRC stands rejected. 8.
However, the trial court is directed to ensure that considering the period of custody undergone, all efforts should be made to conclude the trial so also summoning all the prosecution witnesses at the earliest. Sd/- (P. Sam Koshy) Sumit JUDGE
