For the reasons assigned in the application and found them to be satisfactory, IA No.1 is allowed and delay of 127 days in filing the petition is condoned.
Heard on admission.
Taking into consideration the submissions put forth by the counsel for the petitioner, a strong case has been made out and arguable point has been raised by the petitioner assailing the impugned judgment of acquittal dated 16.10.2015 passed by the Additional Sessions Judge, Ramanujganj, in Criminal Appeal No.40/2015.
Accordingly, the present petition is allowed. Leave is granted. Registry is directed to register this case as an Acquittal Appeal.
The acquittal appeal is also admitted for hearing. As the respondents are represented by respective counsel, requirement of issuance of fresh notice to the respondents is dispensed with.
List it for final hearing in due course.
Petitioner counsel shall supply two complete sets of petition along with memo of appeal to the the counsel for the respondents No.2 to 5.
