1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.70/2016, registered at Police Station Lakhanpur, District Surguja (CG) for the offence punishable under Sections 302, 364, 201, 34 of IPC.

3. The applicant along with co-accused Viphan Kanwar, Raimin Bai and Bharat Kanwar have been charge sheeted for committing

murder and concealing the evidence in relation to death of deceased Suraj, aged about 13-14 years.

4. Apart from the material available in the case diary, deposition of some witnesses, who have been examined during trial, is also perused.

5. Considering the material on record and without commenting on the merits, I am of the opinion that present is not a fit case to release the applicant on bail.
