This contempt petition has been filed alleging willful disobedience of order dated 16-05-2018 passed by this Court in WPS No.3703 of 2018, by which, petitioner's transfer order has been stayed. It is stated that the interim order was still continuing. The petitioner had to approach this Court, because, according to him, even though, on papers, he was being shown as Executive Engineer at Rajnandgaon, the work of the office of Executive Engineer was not being allotted to him and other incumbent of the office, who came on transfer, namely, Mr. Pradeep Lakra, was being given all the duties and functions of the office of Executive Engineer.

On the directions of this Court, the respondent has filed an affidavit by stating that pursuant to interim order passed by this Court, the petitioner and the petitioner alone has been discharging the duties and functions of the office of

Executive Engineer at Rajnandgaon. It is stated that the incumbent has been directed to discharge certain duties other than that of the office of Executive Engineer, Rajnandgaon.

In view of the aforesaid emphatic statement made on affidavit by the Chief Engineer, CSPDCL, Raigarh that the petitioner and the petitioner alone, is discharging the duties and functions of the office of Executive Engineer at Rajnandgaon, this matter now requires to be closed. 5.

Accordingly, this contempt petition is closed. Rule is discharged. In case, it is found that any attempt is made to circumvent the order passed by this Court, appropriate action would be taken against the erring official. A copy of this order be placed for necessary compliance before the Managing Director, CSPDCL, who shall ensure due compliance of the order passed by this Court with all concerned.
