For Respondents/State :

Mr. Sudeep Verma, Dy. G.A.

Hon'ble Shri Justice P. Sam Koshy Order on Board /12/2020 1.

Challenge in the present Writ Petition is to Annexure P-1, dated 15.9.2020, whereby the Petitioner, who is Pharmacist, has been transferred from Primary Health Centre, Sureli, District North Bastar Kanker to Govt. Ayurved Hospital, Farsegarh, District Bijapur.

2.

The primary contention of learned Counsel for Petitioner is that the order of transfer has been passed contrary to the circular of the State Government in respect of transfer.

3.

On a query being put to learned Counsel for Petitioner, he submits that the Petitioner has been working in the present place of posting since July, 2013 which by itself means that he has by now already put in about 7 years of service at the present place of posting.

4.

Given the facts, this Court is not inclined to entertain the present Writ Petition and the same therefore deserves to be and is accordingly dismissed. However, in case, if the Petitioner has any personal grievances so far as the execution of the order and new place of posting is concerned, the right of the Petitioner stands reserved for approaching the Respondents by way of a suitable representation, which if made, the Respondents shall consider and decide the same at the earliest, on its own merits, in accordance with law. 5.

Writ Petition accordingly stands dismissed. Sd/- (P. Sam Koshy) /sharad/ JUDGE
