The applicant has preferred this bail application under Section 439 of Cr.P.C., as he has been arrested in connection with Crime No.43/2017, registered at Police Station Nawapara, District Raipur for the offence punishable under Sections 363, 366, 376 of IPC and Section 6 of Protection of Children from Sexual Offices Act, 2012.

Considering the fact that as per the birth certificate available in the case diary, the prosecutrix was less than 18 years of age on the date when first forcible sexual intercourse took place between the applicant and the prosecutrix, on promise to marry, no case

for releasing the applicant on bail is made out at this stage. Accordingly, the bail application is rejected. However, the applicant would be at liberty to repeat the prayer for bail after examination of the prosecutrix.
