1. Perused the default pointed out by Registry.

2. After perusal of the facts, it appears that Criminal Appeal No.679/2014 has been preferred by the appellant on 17-07-2014 in which delay of 59 days of limitation in filing the said appeal has been condoned and the appeal has been admitted for consideration.

3. As per settled law, this subsequent criminal appeal preferred against the same judgment is not maintainable.

4. Consequently, the instant criminal appeal is hereby dismissed as not maintainable since already Criminal Appeal No.679/2014 is pending for hearing on its merit.

5. Copy of this order be annexed with Criminal Appeal No.679/2014.

6. The instant criminal appeal is dismissed as not maintainable without any appreciation on its merit.
