Heard on IA No.1, which is an application for condonation of delay in filing the petition.

Taking into consideration the facts and finding the reasons assigned in the application to be satisfactory and also there is no strong objection from the respondent, IA No.1 is allowed and delay is condoned.

Taking into consideration the grounds narrated in the memo of petition and also on perusal of impugned order, this court is of the opinion that prima facie arguable point has been made out challenging the judgment of acquittal dated 06.02.2016 in complaint case No.1315 of 2013. Accordingly, this petition is allowed. Registry is directed to register this case as an Acquittal Appeal. Call for the records.

Since the respondent is represented by Shri AN Pandey, Advocate, requirement of issuance of fresh notice to the respondent is dispensed with.

The Acquittal Appeal is also admitted for hearing. List the Acquittal Appeal for final hearing in due course.
