1. The challenge in the present writ petition is to the order of transfer dated 12.07.2019 whereby the petitioner stands transferred from Middle School, Girwarganj, Block Balrampur to Middle School, Dhaneshpur, Block Kushmi, district Balrampur.

2. The contention of the counsel for the petitioner is that the petitioner is the sole teacher working in the said school where she is presently

posted and vide impugned order of transfer she is not being provided any replacement, as such the school would render teacherless. According to the petitioner, the Headmaster who is posted there is continuously absent for more than 2 years and the petitioner is alone independently handling the entire school.

Given the aforesaid factual matrix of the case, let the petitioner make an appropriate representation within a period of 10 days from today to the respondent no.2 who in turn shall consider the contents of the representation and take an appropriate decision including the necessity of posting of a teacher in the event of the petitioner being transferred. Let a decision be taken at the earliest preferably within a period of 45 days from the date of receipt of representation of the petitioner. Meanwhile, the effect and operation of the impugned order, so far as the petitioner is concerned, shall remain stayed.
