Counsel for the appellant submits that appellant Rambhajan S/o Arjun Gond has been convicted by judgment dated 05/05/2015 in Special Sessions Trial No. 76/2015 before the Additional Sessions Judge and Special Judge under Protection of Children From Sexual Offences Act, 2012, Kabirdham (Kawardha) under Section 363 of IPC to undergo RI for 7 years and fine of Rs.500/- with default stipulation, under Section 366(A) of IPC to undergo RI for 7 years and fine of Rs.500/- with default stipulation, under Section 376(2) of IPC to undergo RI for 10 years and fine of Rs.500/- with default stipulation and under Section 4 of the Protection of Children from Sexual Offences Act, 2012 to undergo RI for 7 years and fine of Rs.500/- with default stipulation.

Previously appeal has been preferred by the appellant which is pending before this Court that Criminal Appeal No. 660 of 2016, which is also listed today.

Counsel for the appellant in Criminal Appeal No. 785 of 2016 submits that this appeal is also from the same impugned judgment, hence he wishes to withdraw this appeal.

Prayer made by the counsel is allowed.
