The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.97/2017 registered in Police Station Dantewada, Dist. Dantewada (CG) for the offence punishable under Sections 457, 366, 354, 376/511 of the Indian Penal Code (as per challan) {charges framed under Sections 450, 366, 376/511 of the IPC}.

Applicant has allegedly tried to commit forcible sexual intercourse with the prosecutrix, who is said to be more than 18 years of age, however, considering the vivid description in the FIR as to the manner in which the applicant forcibly abducted the prosecutrix from her house; taken her to an open field; and thereafter undressed her, this Court is not inclined to entertain this bail application at this stage.

Accordingly, the bail application is rejected. However, liberty is reserved in favour of the applicant to repeat the prayer after examination of the prosecutrix.
