Hon'ble Shri Justice P. Sam Koshy Order On Board 07.09.2018 The grievance of the petitioner is that he has got a very short tenure of service left and the claim is for grant of promotion to the post of Assistant Grade-II and seniority at par with his immediate junior. 2.

Perusal of the record would show that the respondents themselves had on an earlier occasion accepted the fact that the petitioner would be entitled for all benefits and continuity of service vide an agreement dated 04.09.1993.

Given the said condition and settlement, this Court does not find any strong reason for denying the petitioner the benefit of seniority and

promotion at par with his immediate junior. Accordingly, the writ petition stands disposed of with a direction to respondent no.2 to consider the case of the petitioner for promotion and also consider granting benefit to the petitioner at par with his immediate junior. Considering the age of the petitioner it is expected that respondent no.2 would take a decision within a period of 90 days from the date of receipt of certified copy of this order. Sd/- P.
