Hon'ble Shri Justice P. Sam Koshy Order On Board 13.09.2018 The petitioner has filed the present writ petition against the inaction on the part of the respondents in not taking a decision on the claim of the petitioner for the post of Lecturer (Panchayat) against one post reserved for the handicapped category.

Counsel for the petitioner submits that the petitioner had scored 2nd rank under the handicapped category and the person who stood at serial no.1 namely Sanjay Ku. Sahu did not appear for the counselling. Therefore, it is the claim of the petitioner which the respondents should have considered for which he was also called for counselling on 07.11.2017. However, thereafter no further development has taken place. The petitioner

in this regard has also made repeated representations to the authority concerned, but no decision has been taken on his representation. 3.

Given the said factual matrix of the case, this Court does not intend to keep the petition pending rather ends of justice would meet if the writ petition is disposed of with a direction to respondent no.2 to take a decision so far as the claim of the petitioner is concerned. While considering the representation of the petitioner, the respondents would keep in mind the fact that the petitioner has already been subjected to counselling and shall also keep in mind the category to which the petitioner belongs and take a sympathetic approach. Let a decision in this regard be taken within a period of 45 days from today keeping in view the validity of the select list. 4.
