Delay in filing the present petition is condoned. The present application has been filed under Section 378 (3) of the Cr.P.C. seeking leave to appeal.

The application is allowed. The leave as prayed for is granted.

Registry is directed to register the Acquittal Appeal. Acquittal appeal is admitted for hearing. As respondent are already represented in the case. State is not required to pay separate process fee.
