(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 19/2015 registered at Police Station Parpodi, District Bemetara for the offence punishable under Section 420 of the Indian Penal Code.

(2) Case of the prosecution, in brief, is that applicant in between 16.03.2013 to 02.07.2014 obtained Rs. 3,50,000/- from complainant Tuman Lal Sahu for securing employment for him in the Govt. Mantralaya, Raipur and, thereby, committed the aforesaid offences.

(2) Counsel for the applicant submits that applicant has been falsely implicated in the offence in question as there is no evidence on record to connect the applicant with the crime in question and he has not taken any money from the complainant. He submit that applicant is in jail since 04.07.2015 and, therefore, the applicant may be released on bail.

(3) On the other hand, counsel for the State opposes the bail application.

(4) Taking into consideration the nature and gravity of the offence and the manner in which the applicant has obtained Rs. 3,50,000/- from complainant for securing him employment on various dates; I am not inclined to release the applicant on bail. Thus, the bail application is rejected.
