1. Learned Counsel for the Petitioner himself very fairly submits that in the instant case he has questioned the framing of charge against the Petitioner dated 10.08.2015.

2. He further submits that during the pendency of the Petition before this Court, the matter has already commenced further and recording of the evidence on behalf of the prosecution has been started.

3. In view of the fact that the evidence has already been started before the Court below, this Court is of the opinion that no fruitful purpose would be served in entertaining the Petition at this juncture.

4. Accordingly, the present Cr.M.P. stands dismissed as having become infructuous.
