1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.192/2013 registered at Police Station Jashpur Nagar, Distt. Jashpur, for the offence punishable under Sections 364A and 365 read with Section 34 of the IPC.
2. Case of the prosecution, in brief, is that the applicant kidnapped the minor Tarun Sao, son of complainant Prasad Sao, for ransom of Rs.20 lakhs and thereby committed the offence.
3. Learned counsel for the applicant submits that the applicant has not committed any offence and he has been falsely implicated in the case, he is in custody since 17-8-2015 and charge-sheet has been filed.
4. On the other hand, learned State counsel opposes the application and submits that the applicant, who is a hardened criminal, demanded Rs.20 lakhs as ransom for releasing the kidnapped complainant's son and as
many as nine criminal cases have been registered against the applicant in the State of Jharkhand.
5. I have heard learned counsel for the parties and perused the case diary.
6. Taking into consideration the nature and gravity of offence, facts and circumstances of the case, the manner in which the minor son of the complainant was kidnapped and ransom was demanded, and looking to the criminal antecedents of the applicant, I am not inclined to grant bail to the applicant. The application is rejected.
