The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.127/2016, registered at Police Station Hasaud, District Janjgir-Champa for the offence punishable under Sections 363, 366, 376 read with Section 34 of IPC and Section 6 of POCSO Act.

At the time of incident, the prosecutrix was aged less than 18 years of age. The prosecutrix as well as her parents have been examined in the month of February, 2017 to April, 2017, therefore, the trial appears to be at the fag end of the trial.

Considering the advance stage of the trial and the age of the prosecutrix, this Court is not inclined to release the applicant on bail at this stage. However, the applicant would be at liberty to repeat the prayer if trial is not completed within a reasonable period. The trial Court is directed to expedite the trial and conclude the same at the earliest.
