(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 39/2015 registered at Police Station Dongargaon, District Rajnandgaon for the offences punishable under Sections 363 & 376 (2)(i)(n) of Indian Penal Code (wrongly mentioned as (h) & (e) in the order sheet), and Section 6 of the Protection of Children
from Sexual Offence Act, 2012 (as per charge framed by the court below).
(2) Learned counsel appearing for the applicant, at the outset, submits that he may be permitted to withdraw the present bail application with a prayer that the trial Court is directed to expedite the trial.
(3) Prayer appears to be fair and reasonable.
(4) Accordingly, the bail application is dismissed as withdrawn. However, the trial Court is directed to expedite the trial. Certified copy, as per rules.
