The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 246/2015 registered in Police Station Champa, District Janjgir- Champa (C.G.) for offence punishable under section 420 R/w Section 34 of IPC.

Prosecution story in brief is that amount of Rs.1,50,080/- and Rs.1,00,080/- was received by the applicant with a promise to pay the same with annual interest and he was handling the company Sai Prasad Foods.

Learned counsel for the applicant submits that charge-sheet has already been filed and the documents have been seized which are in the nature of documentary nature and there is no chances of tampering of the same and virtually it is monetary transaction and no offence is committed

by the applicant, therefore he may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. It is submitted during the course of argument that charge-sheet has been filed, which is not disputed by learned State counsel. 5.

I have heard learned counsel for the parties. 6.

Having regard to the fact that charge-sheet has been filed and applicant is in jail since 22/08/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
