Justice Rajani Dubey Order On Board 05/04/2021 The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody in connection with Crime No. 176/2020 registered at police station Saraswati Nagar, district Raipur (CG) for the offence punishable under Sections 21 of the NDPS Act.

Case of the prosecution in brief is that on receiving secret information the police intercepted and found the applicant carrying 156 bottles of Corex cough syrup and 160 bottles of Rankuf cough syrup.

Counsel for the applicant submits that the applicant has been falsely implicated in the crime and he is in jail since 22.11.2020. He

Having heard counsel for the parties, considered the totality of the fact, in particular the detention period of the applicant, I am inclined to release him on regular bail.
