1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.93/2015 registered at Police Station Pathalgaon, Distt. Jashpur, for the offence punishable under Sections 376 of the IPC, 3, 4, 5 (j) (ii) and 6 of the Protection of Children from Sexual Offences Act, 2012.

2. Taking into consideration the nature and gravity of offence, facts and circumstances of the case and the manner in which the applicant is said to have forcefully committed sexual intercourse with the prosecutrix who was minor on the date of offence, I am of the view that it is not a fit case for grant of regular bail to the applicant.
