Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 24-101. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.

2. The applicant has been arrested in connection with Crime No. 117/2018 registered in police station Dhamdha, Distt. Durg (CG) for offence punishable under Section 420, 384, 120-B of the IPC.

3. Perused the case diary.

4. Prosecution story in brief is that complainant Bhushan Sahu is resident of village Rajpur. Applicant and co-accused persons Badshah Khan, Madar Khan, Raju Khan and Chhote Miyan obtained from him Rs. 20 lacs promising that they will provide job to his daughter, his sister and his son in law in Railway department. Thereafter they convinced the complainant that in his house, wealth is buried and again obtained from him Rs. 85 lacs.

5. Counsel for the applicant argued that the applicant is innocent and falsely implicated hence he may be released on bail. He further submits that there is no role of the applicant in the crime in question and charge sheet is already filed.

6. On the other hand, the State Counsel opposed the bail

application. He further submits that one more case of the same offence has also been registered against the applicant and other accused persons.

7. Looking to the facts and circumstances of the case, looking to the seriousness of the alleged offence and also the impact of granting bail on the society, and looking to the huge amount involved in the matter, this Court is not inclined to grant bail to the applicant.

8. Consequently, the MCRC is dismissed.
