1. The accused/applicants have moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing them on regular bail during trial in connection with Crime No.192/2015, registered at Police Station: Excise Circle, Bilaspur East, Distt. Bilaspur, for the offence punishable under Sections 34 (1) (a), 34 (2) (f) and 59-A of the Chhattisgarh Excise Act, 1915.
2. Taking into consideration the nature and gravity of offence, facts and circumstances of the case, the provisions contained in Section 59-A (ii) of the Chhattisgarh Excise Act, 1915 and quantity of liquor i.e. 90 bulk litres recovered from the possession of the applicants, I do not find it a fit case for grant of regular bail to the applicants. Consequently, the application is rejected.
