2. The applicant has preferred this application for grant of bail as he is arrested on 13-1-2017 in connection with Crime No. 12/2017 registered in PS Magarlod, Distt. Dhamtari (CG) for offence punishable under Section 306, 34 of the Indian Penal Code, 1860.

3. Learned counsel for the applicant submits that after investigation charge sheet has been filed and the same is pending before the Addl. Sessions Judge, Dhamtari as ST No. 15/2017. In the charge sheet, present applicant and co-accused Pururam Verma are arrayed as accused. Name of the deceased is Puja Verma. She is wife of the present applicant. Their marriage was solemnized in the year 2015. The date of incident is 11-1-2017 in the house of the applicant where the deceased wife committed suicide by setting ablaze herself. It is submitted that MCRC No. 4083/2017 preferred by co-accused Pururam Verma has been dismissed by this Court vide order dated 30-6-2017. The applicant has been falsely implicated hence instant MCRC may be allowed.

4. Per contra, learned counsel for the State opposes the bail application.

6. In the present matter, Section 113-A of the Indian Evidence Act, 1872 is applicable as within seven years of marriage the deceased committed suicide. The applicant is husband of the deceased. On due consideration of the evidence collected during investigation regarding cruelty and other facts, instant MCRC is dismissed. Sd/- (Chandra Bhushan Bajpai) Judge Pathak
