1. The appellant has filed this appeal against the judgment of conviction and order of sentence dated 26.04.2016 rendered by 5th Additional Sessions Judge, Raigarh, C.G. in S.T. No.111/2013 whereby and whereunder the appellant has been convicted under Section 302 of the I.P.C. and

CRA No. 838 of 2016 sentenced him to undergo life imprisonment.

2. As per report received from the Superintendent of Central Jail, Bilaspur sole appellant - Manglu Ram son of Gendram Gond has died on 27.02.2020.

3. Learned counsel for the appellant would submit that in death certificate sent to him by the appellant's relative, the date of death is mentioned as 28.02.2020. The same date of death is mentioned in the wireless message sent by the Assistant Superintendent of Central Jail, Bilaspur to this Court on 28.02.2020.

4. The legal heirs/ dependants of the sole appellant have not moved any application seeking permission to prosecute the appeal.

5. In the above circumstances, the instant appeal is dismissed as abated.
